Amended Appellate Procedure Rules Adopted
Article Date: Thursday, July 02, 2009
Today, the North Carolina
Supreme Court, pursuant to its Constitutional rule-making authority, re-adopted
the Rules of Appellate Procedure with amendments.
This revision is the first comprehensive review
and re-issuance since their adoption in 1975. The rules are effective for appeals filed on
or after October 1, 2009.
The changes include provisions for electronic
filing of transcripts, protecting the identity of certain juveniles and
eliminating assignments of error. Chief
Justice Parker noted, “Issuance of these revisions today is the culmination of a
substantial and sustained effort by the members of the Court over the last
eighteen months. Our Court takes
seriously its responsibility in carefully shaping the appellate rules to assure
that appeals can be presented and heard in a fair and impartial manner for all
parties.”
