OMG! :-0 Technology, Social Media & Professionalism

 

861combo.jpgTechnology has changed the way we live, interact with each other, and practice law, for better and for worse. 

Communication is now quick, informal and sometimes sent without appropriate forethought, security, or consideration of its consequences.

Social media present different challenges, including lack of awareness that its use by attorneys is subject to professional regulation and principles of professionalism. Indiscrete chatter on social networking sites has been found to exceed the boundaries of proper communications by lawyers and judges. 

It has even led, in some instances, to the unwitting creation of attorney-client relationships.  South Carolina lawyers must monitor and remove comments from their blogs if a client posts a compliment on "a job well done."

As lawyers, we must master the use of technology because it gives us a valuable tool to aid our clients and to build our practices. We must also understand the evolving and expanding ethical and regulatory obligations to protect our clients' confidentiality and privacy from the misuse of technology by third parties. 

We must also be fully aware of the bounds of appropriate professional conduct for lawyers, their clients, adversaries and judges in the "virtual" world or face the risk of disciplinary sanctions.

James McCauley, Ethics Counsel for the Virginia State Bar, and a panel including Chief Judge John Martin from the NC Court of Appeals and other outstanding attorneys attuned to the intersection of technology and professionalism, will lead the audience in a thought-provoking discussion of hypothetical situations-many drawn from actual events-illustrating emerging issues in attorneys' use of technology and social media.

Add that to the surge in chronic illness, the numbers of children being born with special needs and the prevalence of addiction in our society and family lawyers find themselves faced with an increasing number of complicated issues to sort through when divorcing clients present such issues as a part of their family law case.  

This program is designed to help the family lawyer learn about the following:

  • Particular issues facing parents with special needs children: respite care; planning for the child's care in adulthood, and learning about guardianship law in North Carolina as it applies to disabled adult children, particular child support and custody concerns
