UNPRECEDENTED COVERAGE CONTINUES AT DISCIPLINARY HEARING The media spectacle surrounding the Duke lacrosse case continued Tuesday during the opening day of disciplinary proceedings against Durham County District Attorney Mike Nifong. Commencing at 10 a.m. and continuing through the better part of this week, the State Bar disciplinary hearing has attracted unprecedented coverage, including live video feeds from WRAL-TV, News 14 Carolina, WTVD-TV and other news outlets. IN MEMORIAM It is the sad duty of the North Carolina Bar Association to notify the membership of the deaths of distinguished North Carolina lawyers Robert Bain Broughton of Raleigh and William L. Cooke of Windsor. Both gentlemen were 82 and served their country in World War II. Broughton, the son of former NCBA President J. Melville Broughton who served in the U.S. Senate and as governor of North Carolina, died June 5. DELAWARE RULING MAY IMPACT “ZONE OF INSOLVENCY” ACTIONS Bankruptcy lawyers nationwide have taken note of a recent ruling by the Delaware Supreme Court and its impact on cases against company officers and directors for actions taken shortly prior to filing for bankruptcy. The court ruled that creditors of an insolvent Delaware corporation cannot assert direct claims for breach of fiduciary duty against its directors (North American Catholic Educational Programming Foundation Inc. v.
