Educational Decision-Making for Children Experiencing Foster Care

Children experiencing foster care encounter significant obstacles in accessing their education, including frequent school changes, enrollment delays, missing credits, unreliable access to appropriate support services, and inconsistent identification for early intervention and special education services. Confusion over educational decision-making authority compounds these challenges, resulting at times in delayed, or nonexistent, education advocacy on their behalf.
In this Expert Series, education law attorneys Caitlin Whalan Jones and Stephanie Klitsch discuss the legal framework for educational decision-making for children experiencing foster care and discuss opportunities for improved collaboration between stakeholders to better support children’s educational needs.
